This course will explore techniques to recover assets from trusts that are designed to shield assets. The course begins by explaining some basics about trust, such as the differences between revocable, irrevocable, self-settled, and third-party trusts. We then discuss potential ways to access assets held in spendthrift and beneficiary trusts. Next we talk about the relatively new innovation of the domestic asset protection trusts, which are built to shield assets from creditors. DAPTs provide powerful protection from creditors, but there remain ways to access assets held in these trusts. This is a course designed for those who seek recovery of assets for bankruptcy and receivership estates or to collect on judgment liens. The course will also benefit those attorneys who draft these types of trusts.
